Catesby Submit Appeal

RESIDENTS are gearing up for the next round of a battle to stop developers building homes on their doorsteps.

Catesby Estates, which wants to build up to 400 homes off Kedleston Road, Allestree, has lodged an appeal against Amber Valley Borough Council's decision to refuse planning permission for the houses.

The appeal has been submitted to Local Government Secretary Greg Clark, who will make a final decision on whether the planning should be granted or refused following a public inquiry.

This will feature barristers representing Catesby, the council and protest group Kedleston Voice.

A Kedleston Voice spokesman said: "We have taken advice from our barrister, and we now need to instruct him to represent us, but we need help to afford this.

"We have already raised £14,000 in a short space of time. But we need to increase this to the £30,000 required to cover the cost of crucial high-quality legal representation.

"We have a very strong case, backed by a raft of evidence, which states that this land should not be built on. We are confident that, with the correct level of legal representation, we can win this battle.

"As a community, we should be proud of what we have achieved so far but, now the fight has escalated, the gloves are off."

Plans for the development were turned down by the council in July and the site was then removed from the authority's proposed "core strategy", which earmarks sites in the borough that could be used for homes by 2028.

Catesby's plans were rejected by councillors on the grounds that the work would damage the setting of the grade I-listed Kedleston Hall.

Planning officers state in a report that the development would cause "less-than-substantial harm" to the setting. They add that this harm would be "irreversible and irreplaceable".

Catesby has previously stated: "The need for housing in the borough remains desperate."
